The city of Pomona has delivered a cease-and-desist letter to Carvana demanding an immediate stop to the used-car dealer’s activity at Fairplex, officials confirmed Wednesday, Aug.18.

Dated Aug. 3 and written by City Attorney Sonia Carvalho, the letter said Carvana is operating an “illegal vehicle storage business,” which includes the unloading and loading of cars at Fairplex, home to the LA County Fair. The area in question is zoned to allow for fair-related uses, the letter reads, but the activity currently taking place is not considered as such.

In addition, the letter points out that Carvana is operating without a required land-use permit, city-issued business license and a state-required environmental analysis of its project.

Carvana and Fairplex officials did not respond to requests for comment by late Wednesday afternoon.

Carvana activity at Fairplex has created a “public nuisance,” the city’s letter continues, referencing nearby residents’ complaints that include car and noise pollution caused by large transport trucks. The city also has received grievances about loud music being played by Carvana employees.

“Not only is your use an ongoing violation of the law, it is also a public nuisance,” the city’s letter reads. “Your illegal activity causes significant noise, dust, vibration, air quality and traffic impacts on the surrounding area.”

The letter demands that Carvana stop operations at Fairplex within 30 days of receiving the city’s notice. Thereafter, the company must schedule and undergo an inspection by the city’s code enforcement staff to check for compliance.

If Carvana ignores the city’s demands, additional legal and enforcement action will be taken without warning, reads the letter reads, confirmed Wednesday by city spokesman Mark Gluba.

Fairplex, owned by Los Angeles County but operated by the Los Angeles County Fair Association, previously announced an agreement with Carvana to allow the company to use some of its parking lot. It was not clear Wednesday when Carvana began operating at Fairplex.

Meanwhile, plans for a Carvana distribution and processing center at Fairplex are under development. The proposal calls for a 200,000-square-foot warehouse on 85 acres near Fairplex’s Gate 9. Additionally, there would be storage room for 7,000 vehicles and space for 450 on-site parking spots. The site would result in more than 2,600 vehicle trips weekdays, officials have said.

In response to residents’ concerns, Councilmember Robert Torres, whose district encompasses the area surrounding Fairplex, plans to host a town hall to discuss Carvana’s proposal. The meeting is set for 6:45 p.m. Thursday, Aug. 19, at Ganesha Park, 1575 N. White Ave.
