California school districts dodged a suit alleging that they insufficiently accommodated disabled students during the Covid-19 pandemic because the students didn’t comply with a federal education law’s administrative exhaustion requirement, the Ninth Circuit said Wednesday.
The proposed class action alleged that every school district in the state failed to provide special needs students with a free appropriate public education after moving to remote instruction, in violation of the Individuals with Disabilities in Education Act and the 14th Amendment to the US Constitution.
