New York state gyms remain closed indefinitely as ‘dangerous activity’ during pandemic, Cuomo says - syracuse.com

Albany, NY -- Gyms across New York State will remain closed indefinitely as a “dangerous activity” as the Covid-19 pandemic continues slamming other parts of the country, Gov. Andrew Cuomo said Thursday.

Gyms are one of the few remaining businesses that have not been cleared for some level of reopening following the March coronavirus shutdown. And Cuomo told reporters there’s no timetable for reopening them.

“Gyms have been a nationally identified source of infections,” Cuomo said, adding: “We know from the other states they’ve been highly problematic.”

The governor said he knows people want to work out. “I know,” he said. “We also know that is a dangerous activity.”

The state’s budget director, Robert Mujica Jr., added that the state is actively considering reopening proposals submitted by gyms across state.

“We continue to look at it,” Mujica said, but cautioned it was still considered a “high risk” activity.

Gyms — along with movie theaters, bowling alleys and a few other businesses where people congregate — were originally included in the state’s four-phase reopening plan. But they were removed, and officials say they pose a uniquely high risk during the pandemic.

The ban on reopening gyms hasn’t sat well with some owners. In May, a Herkimer gym owner threatened to reopen in violation of the state’s order, before relenting. And Aspen Athletic Clubs, which owns several gyms in the state, has sued the governor, alleging unfair treatment. Similar lawsuits on behalf of other gyms are also seeking a judge’s order blocking the state from enforcing the ban. Those cases go to court later this month.

Cuomo said that scientists have pegged gyms as being a place that Covid-19 has spread in other states. Some states reopened their gyms, only to have to close them again, the governor said.

While New York is doing well -- the positive test rate remained under 1% statewide Thursday -- Cuomo said the rising rates in the Northeast and other parts of the country show how easy a “ricochet” back to New York can be.

New Jersey, which has seen an increase in recent Covid cases, also has kept its gyms closed, Cuomo noted.

“We have this storm of spread all around us, and we have to be very careful,” the governor said. “Well, let’s open dangerous activities, I don’t think now is the time to do it.”
